FMLA UPDATE - The recent decision of US District Court Northern
District of Illinois Eastern Division in connection with Case No. 03 C 9419
dated December 28, 2005, has generated quite a lot of speculation and Emails
among unionized segments of the rail industry. While the Court’s decision
provides a positive tilt toward the original arguments advanced [collectively]
by various railroad labor unions, there was also legal opinion concerning its
effect and the extent to which the decision itself could be immediately
enforced.
